Acceptable Use Policy

Voice by EstimatorPro answers calls, sends texts, and captures leads on your behalf. Because it speaks and messages real people in your name, how you use it matters. This policy sets the ground rules.

The short version. Use Voice for legitimate communication with your own customers and prospects, get the consents the law requires, and don't use it for spam, fraud, harassment, or anything illegal. Break these rules and we can suspend or terminate your account.

1. Scope

This Acceptable Use Policy (the "AUP") applies to your use of Voice by EstimatorPro (the "Service"), a product of Pascat Graphics & Marketing ("Pascat," "we," "us"). It is part of, and incorporated into, our Terms of Service. It applies to you, anyone you allow to use your account, and the calls, texts, and content the Service handles for you. Capitalized terms not defined here have the meaning given in the Terms.

2. You are responsible for how the Service is used

The Service acts for your business. You are responsible for the instructions you give it, the information and scripts you load, the consents you obtain, and every call and message it makes or receives on your behalf — as if your own staff had done it. You must comply with all applicable laws and regulations, including telemarketing, calling, recording, and messaging laws, and with our Calls & Messaging Terms.

3. Prohibited uses

You may not use the Service, or allow it to be used, to:

  • violate any law, regulation, or third-party right, or to facilitate anything illegal;
  • place or send calls, texts, or messages without the consent required by law, or to anyone who has opted out, asked you to stop, or is on a do-not-call list you are required to honor;
  • send spam, bulk unsolicited messages, or conduct unlawful telemarketing or robocalling;
  • record calls without providing the notice or obtaining the consent required in the relevant jurisdiction(s);
  • harass, threaten, defame, stalk, or abuse any person, or contact people repeatedly after they've asked you to stop;
  • deceive or defraud anyone, impersonate another person or business, or misrepresent who is calling, who you are, or your affiliation;
  • promote or facilitate scams, phishing, illegal financial schemes, or the unlawful sale of regulated goods or services (for example, controlled substances, weapons, or counterfeit goods);
  • collect, store, or share sensitive personal information beyond what your business legitimately needs, or handle protected categories of data (such as health or financial account information) in violation of law;
  • transmit malware, attempt to gain unauthorized access to any system, probe or test the vulnerability of our infrastructure, or interfere with or disrupt the Service;
  • reverse engineer, scrape, resell, or sublicense the Service except as expressly permitted in the Terms;
  • exceed reasonable usage, generate artificial or fraudulent call/message volume, or impose an unreasonable load on our systems or our providers' systems;
  • use the Service to build or train a competing product, or to benchmark it for a competitor; or
  • engage in any activity that exposes Pascat, our providers, or our other customers to legal liability or reputational harm.

4. Consent, disclosure & opt-outs

Many of the obligations above come down to consent and disclosure. You are responsible for obtaining and keeping records of all consents required to call, record, and text the people you communicate with, for honoring opt-out and STOP requests promptly, and for any AI-interaction disclosures required where you operate. Our Calls & Messaging Terms explain these obligations in more detail; both documents apply together.

5. Your content and scripts

You are responsible for the accuracy and legality of the business information, knowledge, pricing, offers, and scripts you provide to the Service. Don't load content that is false, misleading, infringing, or unlawful, and don't instruct the agent to make promises or claims your business can't lawfully make or honor.

6. Monitoring & enforcement

We don't routinely monitor the content of your calls or messages, but we may investigate suspected violations and may access account data as needed to do so. If we believe you've violated this AUP, we may, with or without notice depending on severity: warn you; require you to fix the issue; throttle, suspend, or limit the Service; remove offending content or configuration; and/or terminate your account under the Terms. We may also act when required by a carrier, messaging aggregator, AI provider, or law. Where we reasonably can, we'll give you notice and a chance to cure, but urgent or legal risks may require immediate action.

7. Suspension and the effect on fees

A suspension or termination for violating this AUP is not a defect in the Service and does not entitle you to a refund. Refunds are governed solely by our Refund Policy.

8. Reporting abuse

If you believe the Service is being misused, or you've received calls or messages that violate this policy, contact us at pascatgraphics@gmail.com. Include the phone number(s), dates, and times involved so we can investigate.

9. Changes to this policy

We may update this AUP from time to time. The "Last updated" date above shows the most recent version, and material changes take effect as described in the Terms. Continuing to use the Service after an update means you accept the revised AUP.
