Calls & Messaging Terms

Voice answers phone calls, records and transcribes them, and sends text messages on your behalf. Those activities are regulated. This page explains the rules that apply — to us, and especially to you as the business using the Service.

The short version. You're the one calling, recording, and texting your customers — Voice is the tool. You must get the consents the law requires, disclose recording where required, honor opt-outs and STOP requests immediately, and register your text traffic. We give you the tooling; you own the compliance.

1. Scope

These Calls & Messaging Terms apply to your use of Voice by EstimatorPro (the "Service"), a product of Pascat Graphics & Marketing ("Pascat," "we," "us"). They are part of, and incorporated into, our Terms of Service and work alongside our Privacy Policy and Acceptable Use Policy. If you don't agree with these terms, don't use the calling and messaging features.

2. Who is responsible for what

You decide who gets called and texted, what is said, and why. That makes you the party legally responsible for those communications — the "caller," "sender," and, for data-protection purposes, the controller of the personal information involved. We provide the technology and act on your instructions. You are responsible for ensuring your use of the Service is lawful in every jurisdiction you operate in and reach.

3. Call recording & consent

The Service records and transcribes calls so it can understand callers, capture details, and create the records you see. Recording law varies:

  • One-party consent jurisdictions generally allow recording if one party to the call consents.
  • All-party (two-party) consent jurisdictions require that everyone on the call consents before recording.

Because your callers may be located anywhere, you are responsible for determining what applies and for providing any required notice or obtaining any required consent — for example, an audible disclosure at the start of the call that it may be recorded. You can configure the agent's greeting to include a recording and AI disclosure, and we strongly recommend you do so. You are responsible for the wording and adequacy of that disclosure under the laws that apply to you and your callers.

4. AI / automated-voice disclosure

Voice uses an automated, AI-generated voice. A growing number of jurisdictions require that people be told when they're interacting with AI or an automated system, particularly in certain contexts. You are responsible for configuring and providing any AI-interaction disclosures required where you and your callers are located. We provide the ability to disclose; you decide and are responsible for what is disclosed.

5. Outbound calls & the TCPA

If you use the Service to place outbound or automated calls or to send pre-recorded or artificial-voice messages, U.S. laws including the Telephone Consumer Protection Act (TCPA) and related FCC rules — and similar laws elsewhere — may apply. Among other things, you are responsible for:

  • obtaining the level of consent the law requires (which can include prior express written consent) before placing marketing or automated calls or texts;
  • honoring the National Do Not Call Registry and any internal do-not-call requests;
  • respecting permitted calling hours and identification requirements; and
  • keeping records of the consents you rely on.

You bear sole responsibility for TCPA and equivalent compliance for communications you direct through the Service.

6. Text messaging & A2P 10DLC registration

Application-to-person (A2P) text messaging in the U.S. is subject to carrier registration requirements, commonly called 10DLC. To send texts through the Service, you (with our help) generally must register your brand and messaging campaign(s) and accurately describe your use case, opt-in method, and message content. You agree to:

  • provide accurate registration information and keep it current;
  • only send messages that match your registered, approved use case;
  • obtain proper opt-in consent before texting anyone and keep proof of it; and
  • comply with carrier and aggregator rules, messaging policies, and content restrictions (for example, rules limiting certain regulated or prohibited content).

Carriers and aggregators may filter, block, throttle, suspend, or reject messages or registrations at their discretion. Those decisions are outside our control and are not a defect in the Service.

7. Opt-outs, STOP & HELP

Recipients can opt out of text messages at any time by replying STOP (and similar keywords), and can request help with HELP. The Service is designed to recognize standard opt-out keywords, and you must honor every opt-out and do-not-contact request promptly — across calls and texts — and must not text someone again after they opt out unless and until they opt back in. You are responsible for maintaining and honoring your suppression lists.

8. Message & data rates; frequency

Standard message-and-data rates may apply to the people you and the Service text, and message frequency varies based on the conversation. You are responsible for setting recipient expectations about frequency and for any disclosures your messaging program requires.

9. Prohibited content & conduct

You may not use the calling or messaging features for spam, unlawful telemarketing, harassment, fraud, or any purpose prohibited by our Acceptable Use Policy. Prohibited or heavily restricted message categories under carrier rules (for example, certain regulated products and high-risk financial content) must not be sent through the Service unless expressly permitted and properly registered.

10. How call & message data is handled

Recordings, transcripts, and message content are processed to operate the Service and are handled as described in our Privacy Policy, including how long they're kept and who they may be shared with (such as our telephony, messaging, and AI subprocessors).

11. Enforcement

If you violate these terms, we may suspend or terminate calling and/or messaging features or your account as described in the Terms and Acceptable Use Policy, and we may act when required by a carrier, aggregator, provider, or law. Suspension or termination for a compliance violation is not a defect and does not entitle you to a refund under the Refund Policy.

12. Your responsibility

You agree to indemnify and hold harmless Pascat and our providers from claims arising out of communications you direct through the Service, including claims under the TCPA, recording-consent laws, messaging regulations, and related rules, as further described in the Terms.

13. Changes

We may update these Calls & Messaging Terms as laws, carrier rules, and our Service evolve. The "Last updated" date above shows the current version; continuing to use the calling and messaging features after an update means you accept the change.
