Refund Policy

We price our plans fairly and let you cancel anytime. In exchange, we keep our refund terms simple and firm: we do not issue refunds for change of mind. Limited remedies apply if the product is genuinely defective or fails to perform as described.

The short version. Subscriptions are month-to-month — cancel anytime and you won't be billed again. Setup fees and already-paid monthly fees are non-refundable except in the narrow circumstances described below, where the Service is defective or materially fails to perform as described and we are unable to fix it within a reasonable time.

1. What this policy covers

This Refund Policy applies to fees paid for Voice by EstimatorPro (the "Service"), a product of Pascat Graphics & Marketing ("Pascat," "we," "us"). It works alongside our Terms of Service. Where this policy and the Terms differ on refunds, this policy controls.

2. Cancellation (different from a refund)

You can cancel at any time, effective at the end of your current billing period. Cancelling stops future charges. It does not retroactively refund the current period or any prior period. You keep access through the period you've already paid for.

3. Setup fees are non-refundable

The one-time setup fee pays for real work performed up front — building your agent, loading your services, pricing, hours, and service area, configuring lead delivery and alerts, routing your number, and running live test calls. This work is rendered before your first real call. Accordingly, setup fees are earned when work begins and are not refundable, including if you later cancel or change your mind.

4. Monthly fees — no change-of-mind refunds

Monthly subscription fees are billed in advance for access to the Service. We do not provide refunds or pro-rated credits because you:

  • changed your mind, no longer want the Service, or didn't use it as much as expected;
  • did not provide the business information, consents, or access needed for the Service to work;
  • experienced a business outcome you hoped for but we never guaranteed (for example, a specific number of booked jobs); or
  • cancelled mid-period.

5. Defective or non-performing product — the limited exception

We stand behind the Service. If the Service is defective or materially fails to perform as described by us in writing, and the failure is caused by us (not by the factors in Section 6), you may be entitled to a remedy. To qualify, all of the following must be met:

  1. It's a genuine defect or material failure. A reproducible fault that prevents the Service from performing a core function we described — for example, the agent fails to answer provisioned calls, or leads are not delivered — not a cosmetic issue, an isolated misunderstanding by the AI, a one-off interruption, or a feature working as designed but differently than you'd prefer.
  2. You reported it promptly. You notified us in writing at pascatgraphics@gmail.com within seven (7) days of the issue arising, with enough detail (dates, times, examples) for us to investigate.
  3. You gave us a chance to fix it. You allowed us a reasonable period — at least ten (10) business days — and reasonable cooperation and access to diagnose and remedy the issue.
  4. We could not remedy it. Despite reasonable efforts, we were unable to fix the qualifying defect within that period.

If all four conditions are met, your remedy, at our election, will be one of: (a) re-performance or correction of the affected Service; (b) a service credit for the affected period; or (c) a refund of the fees you paid for the affected period during which the qualifying defect prevented core performance. A refund under this section is limited to the affected period and will not exceed the fees you actually paid for that period. This is your sole and exclusive remedy for a defective or non-performing Service, except for rights that cannot be waived under applicable law.

6. What does not qualify

The exception in Section 5 does not apply, and no refund or credit is owed, where the issue results from:

  • inaccurate, incomplete, or unlawful information, scripts, or knowledge you provided;
  • your failure to obtain required call-recording or messaging consents, or other misuse under the Acceptable Use Policy;
  • your telephone carrier, number porting/forwarding delays, internet, devices, or other systems outside our control;
  • outages, changes, or failures of third-party telephony, messaging, or AI providers;
  • force-majeure events, or use of the Service in a way we did not authorize or describe;
  • requests made after the reporting window in Section 5, or where you declined to let us remedy the issue.

7. How to request a remedy

Email pascatgraphics@gmail.com with your business name, account, the dates and times affected, and a description of the problem. We'll acknowledge your request, investigate, and respond. Approved refunds are issued to the original payment method within a reasonable time after approval.

8. Disputes & chargebacks

Please contact us first — we resolve legitimate issues quickly. Initiating a chargeback without first giving us the opportunity described in Section 5 may result in suspension of the Service. We reserve the right to dispute chargebacks that contradict this policy.

9. Your statutory rights

Nothing in this policy limits any rights or remedies you may have that cannot be excluded or limited under applicable consumer-protection law. Where such law grants you a remedy, this policy applies in addition to, not instead of, that law.
